Dale F. Gardiner

Dale F. Gardiner, an attorney since 1976, is a member of the firm's Litigation Section. Mr. Gardiner focuses his practice in the areas of governmental relations, water law, and complex litigation matters. He has practiced before the United States Supreme Court and has successfully argued cases before the United States Court of Appeals for the Ninth Circuit, the United States Court of Appeals for the Tenth Circuit, the Utah Court of Appeals, and the Utah Supreme Court. Mr. Gardiner obtained precedent-setting decisions in local governmental law. (Anderson Development Co. v. Tobias, 528 Utah Adv Rep 3 (Utah 2005); In re Disconnection of Territory, 646 P.2d 699 (Utah 1982); and in CERCLA natural resource damage claims litigation Utah v. Kennecott Corp., 801 F.Supp. 553 (D. Utah 1992), appeal dismissed 14 F.3d 1489 (10th Cir. 1994)).
Mr. Gardiner received his B.A. in Mass Media Communications from Brigham Young University in 1973, and his J.D., cum laude, from J. Reuben Clark Law School, Brigham Young University in 1976. He was an Associate Editor of the BYU Law Review. Mr. Gardiner was an adjunct professor at BYU where he taught undergraduate business and communications law (FCC and FTC) courses. He has spoken and published on water and governmental ethics issues.
Mr. Gardiner is a member of the Utah State Bar, the American Bar Association, the American Water Works Association, and the Colorado River Water Users Association. Currently, he is a member of the Board of Trustees of the Jordan Valley Water Conservancy District. Mr. Gardiner formerly served as Mayor of Riverton City (1982-1989). He was a member of the Salt Lake County Boundary Commission (1986-1989). Mr. Gardiner was also a former Vice Chairman of the Salt Lake County Board of Health (1987-1989).
