Mark A. Wagner is Chair of VanCott's Labor and Employment Practice Group and a member of VanCott's Litigation Section. Mr. Wagner concentrates his practice in labor and employment law, utilities, administrative law, appellate law and practice, and general commercial litigation.
Mr. Wagner has extensive experience in counseling and representing employers in virtually all aspects of the employment relationship, including employee recruiting, screening, and hiring; temporary staffing; immigration law compliance; discrimination, harassment, and retaliation compliance, investigations, and claims; wage and hour law compliance, audits, and claims; employee leave issues; employee drug and alcohol testing, medical exams, and genetic testing; workplace theft; employee privacy; occupational safety and health; workplace violence; employee personnel files; employer recordkeeping requirements; union organizing efforts; mass-layoffs; employee discipline and discharge; and wrongful termination. Mr. Wagner also counsels and represents employers in connection with confidentiality, non-solicitation, and non-compete agreements, employer trade secrets, and employment inventions. He represents employers in administrative audits, investigations, and proceedings in front of federal and Utah agencies, and in federal and Utah courts at both the trial and appellate levels.
Mr. Wagner is the Utah delegate to the Labor and Employment Law Group of Lex Mundi, the World's leading association of independent law firms, and serves as Director of Legal and Legislative Affairs for the Salt Lake Society of Human Resource Management. He is regularly recognized by Utah Business Magazine as one of Utah's "Legal Elite" in the area of Labor and Employment Law.
