MARK A. WAGNER is a shareholder, a member of Van Cott's Litigation Section and Chair of Van Cott's Employment and Employee Benefits Practice Group. Mr. Wagner concentrates his practice in labor and employment law, utilities, administrative law, appellate law and practice, and general commercial litigation. Mr. Wagner has extensive experience in counseling and representing employers in virtually all aspects of the employment relationship, including employee recruiting, screening, and hiring; temporary staffing; immigration law compliance; discrimination, harassment, and retaliation compliance, investigations, and claims; wage and hour law compliance, audits, and claims; employee leave; drug and alcohol testing, medical exams, and genetic testing; workplace theft; employee privacy; occupational safety and health; workplace violence; employee personnel files; employer recordkeeping requirements; mass-layoffs; employee discipline and discharge; and wrongful termination. Mr. Wagner also counsels and represents employers in connection with confidentiality, nonsolicitation, and noncompete agreements, trade secrets, and employment inventions. He represents employers in administrative audits, investigations, and proceedings in front of federal and Utah agencies, and in federal and Utah courts at both the trial and appellate levels.  He also counsels and represents homeowners associations, housing authorities, and other real property owners, lessors, and managers in administrative and judicial proceedings under the federal and Utah Fair Housing Acts. He has received the highest possible rating (AV) from Martindale-Hubbell.  He is consistently listed in Utah Business Magazine as one of "Utah's Legal Elite," and is listed in The Best Lawyers in America (Labor & Employment Law, 2010; Employment Law, 2011; Salt Lake City Lawyer of the Year - Employment Law -  Individuals, 2012).
